A BART(Bay Area Rapid Transit) police offcer was involved in a shooting on new years day. The shooting was caught on a cell phone camera. Here is the youtube link of the cell phone video:

Mind you this occurred in Oakland, CA.

Nope. He's fucked. He just surrendered on a murder warrant, 2nd degree. They are going after him full bore. It's a racial issue, waaay too much video out there, and appeasement is the name of this game.

I totally agree with CAMedic! He's fucked. If you watched the videos closely, he simply fucked up. It was a ND 1st class. Pure and simple. Did you see the look on his face right after the discharge?

I don't think it was an AD (or ND as some people call them). The officer clearly drew his weapon when the suspect was resisting with open hands on the ground. I hate to monday morning quarter back, but the only clear reason would be he thought he was drawing and firing his taser.
If this is the case....and he gets a REALLY good lawyer it might be ok for him and bad for the rest of us (cops).
Tasers are AWSOME tools...my department has fought against tasers for years (only supervisors and TACT team officers carry them right now) ...
I guess we will see what happens when (if) it goes to court...

I would say he's pretty fucked. Like NC-cop said I don't want to monday morning QB, but i can't understand why he took his weapon out.

Worst part is Jerry Brown is the Attorney General in California (WTF-he used to be known as Gov Moonbeam). Being in a cop now in California is difficult. I'm glad I left California Law Enforcement years ago. I hope the former BART officer has a decent attorney.

He's done. The whole scene was a monkey fuck. No contact/ cover, nothing remotely looking lke they were trained for anything. He may have had reason to have his weapon out prior to what was recorded but I can't see any reason for it to be out during the contact being shown.
