IS THE IRS REALLY LOOKING OUT FOR YOUR BEST INTEREST?

by Rick Thorne

In our complex society the IRS plays a pivotal role in determining what level of comfort we enjoy today. In order for us to form a clear picture of this undesirable creature we need to understand how it came into being. Contrary to what the talking heads (the media) would have you believe, the IRS isn’t your best friend. In fact, we’re taxed on every conceivable product or service in America. Each time we buy or sell Uncle Sam has his hand out. It’s a tax on a tax on a tax.

The wealthy pay little or no taxes compared to the huge profits generated through their vast investments. They hide much of their money in tax free foundations or charitable trusts. Who pays the lion’s share of taxes? Why it’s none other than people like you and I. Don’t kid yourself! Our tax system is designed to enslave the middle class and the poor. I hear the same thing all the time! It’s anti American if one refuses to pay their taxes. Believe me, it’s anti American the way we’re being taxed to death in this land we call the United States. Don’t think for one minute when the new administration takes over in January 2009 things will be much better...

From childhood all of us are taught to accept things as they are and not question what others have filled our sensitive minds with. If the 1960s revealed anything it showed us things aren’t always as they seem. While on the surface you and I are taught to love and respect God and country. Just below the surface some very sinister things are taking place. Sad to say, but your government isn’t looking out for you. The fat cats in washington are milking the system while you and I are picking up the tab.

Recently I received a DVD by Arron Russo (Hollywood award winning film director of such films, The Rose and Trading Places) called; “America Freedom to Fascism.” The cover jacket of the video states; Neither left, nor right-wing this startling examination of government exposes the systematic erosion of civil liberties in America since 1913 when the Federal Reserve system was fraudulently created. Through interviews with U.S. Congressmen, a former IRS Commissioner, former IRS and FBI agents, tax attorneys and authors, Russo connects the dots between money creation, federal income tax, and the national identity card (which becomes law in May 2008).

A Radio Frequency Identification (RFID) technology chip will be inserted into it at no extra charge. Could this be a precursor to an impending police state in America? I urge everyone reading this article to go on the web and purchase this fascinating new video. You’ll quickly discover what the author’s of the books 1984 and Brave New World wrote about are indeed coming true right now. What’s so wrong with our income tax law?

For one thing it was never ratified by the 16th Amendment of our U.S. Constitution. In 1913 Secretary of State Philander Knox FRAUDULENTLY announced its ratification allthough 3/4 of our elected officials didn’t approve it at the time. christianparty.net/irs.htm

Did you know INCOME TAXES ARE VOLUNTARY? 7. According to the IRS Mission Statement, the Federal Tax Regulations, the Internal Revenue Manual, the US?Supreme Court, and expert testimony given before Congress, the tax system is based on VOLUNTARY COMPLIANCE: a) "The mission of the Service is to encourage and achieve the highest possible degree of VOLUNTARY COMPLIANCE with the tax laws and regulations and to maintain the highest degree of public confidence in the integrity and efficiency of the Service." Federal Register, Volume 39, #62 (11572), March 29, 1974. b) "The purpose of publishing revenue rulings and revenue procedures in the Internal Revenue Bulletin is to promote correct and uniform application of the tax laws by Internal Revenue Service employees and to assist taxpayers in attaining maximum VOLUNTARY COMPLIANCE." Federal Tax Regulations, Section 601.601. c) "The tax system is based on VOLUNTARY COMPLIANCE." Federal Tax Regulations, Section 601.602. d) "Taxpayers in the United States assess their tax liabilities against themselves and pay them VOLUNTARY.

This system of assessment and payment is based on the principle of VOLUNTARY COMPLIANCE." Internal Revenue Manual, Section 20:123 (7/15/96). e) "Of course, the Government can collect the tax from a District Court suitor by exercising its power of distraint ~ if he does not split his action ~ but we cannot believe that compelling resort to this extraordinary measure is either wise or in accord with congressional intent. Our system of taxation is based upon VOLUNTARY assessment and payment, not upon distraint." US Supreme Court, Flora v. United States, 362 US 179, 80 S.Ct. 630 (1960).

NOTE: Neither the Federal Tax Regulations nor the Internal Revenue Code DEFINE the term `VOLUNTARY COMPLIANCE'. Hence plaintiff relies on the definitions of `VOLUNTARY' given in Corpus Juris Secundum (C.J.S. 92: 1029, 1030,1031): "The word `VOLUNTARY', which connotes an agreement, implies willingness, volition, and intent. It suggests a freedom of choice and refers to the doing of something which a person is free to do or not to do, as he so decides. Legally speaking, and as commonly used in law, the word `VOLUNTARY' is defined as meaning gratuitous; without valuable consideration; acting, or done, of one's own free will without valuable consideration; acting, or done, without any present legal obligation to do the thing done." Dwight E. Avis, Head of the Alcohol and Tobacco Tax Division of the IRS, testified before Congress that income tax is 100 percent VOLUNTARY.

It’s vividly clear THE LAW states the payment of income taxes is VOLUNTARY, as codified in the IRS Mission Statement and in Sections 601.601 and 601.602 of the Federal Tax Regulations, and affirmed by Section 20:123 of the Internal Revenue Manual, by the US Supreme Court in Flora v. US, and by the expert testimony of Dwight E. Avis before Congress.

The defendant (I.R.S.) does not have the legal right to issue an involuntary federal tax lien under section 6321 of the Internal Revenue Code, because such a lien violates the?principle of VOLUNTARY COMPLIANCE. Since the law clearly states that the payment of income taxes is VOLUNTARY, defendant acted erroneously and unlawfully by compelling the sum of $14,609.97 to be withheld from the sale of plaintiff's home on 10/14/99 under protest by means of an involuntary federal tax lien.

According to the true and correct usage of the word `VOLUNTARY' in standard English and in legal English, plaintiff cannot be compelled to do something that is VOLUNTARY, such as the payment of income tax ~ which is VOLUNTARY. By compelling plaintiff to pay income tax by means of an involuntary federal tax lien, defendant (I.R.S.) violated plaintiff's intrinsic right to freedom of choice in the matter without compulsion or legal obligation. Why is it the media persecutes American citizens (Wesley Snipes, some former I.R.S. agents and others) who refuse to pay “INCOME TAXES?” We mustn’t forget the media is controlled by hidden forces far above our government. Why is it the media broadcasts what they want us to hear and not necessarily the truth? We either get half the story or none of it! Have you ever wondered why nearly all programmers schedule their commercials at the same time?

The next time you watch television and a commercial popes up flip the channel (especially during news casts) and you’ll see what I mean. You and I are being secretly programmed and we don’t even know it. Did you know the new television sets have built in cameras? Big brother is watching you and you don’t even know it. You know FEAR is a powerful thing. It causes people to think and act in manner they normally wouldn’t associate themselves with if conditions were different. Why is it citizens continue to pay INCOME TAXES when the law clearly states, “IT’S A VOLUNTARY TAX!” FEAR! If we refuse to pay INCOME TAXES we know the I.R.S. will haul us into court.

We know they can ILLEGALLY take our very existence away from us if we refuse their unholy demands. The only saving grace we have is the jury will rule in our favor if we’re hauled into court. Remember! The judge has been conditioned to defend the I.R.S. and not the law as it’s been written. CLEARLY! The VOLUNTARY TAX LAW gives us the right to object if we don’t want to pay INCOME TAXES. The question is do we want to challenge our government and be persecuted by the I.R.S? Rick Thorne

All the references to taxes being voluntary and the supposed documentation supporting those contentions have already been settled by case law in the courts. Additionally, a number of tax protesters who quoted the same rhetoric are looking out from behind the bars at federal prisons. We can gripe and bitch as much as we want, but two things are undeniable in this life....taxes and death.

Haven't seen the video referenced but will try and take a look. It sounds like they covered some of the points I made in an earlier message regarding the North American Union, the national identification card, replacement of the dollar with the Amero and substitution of the Constitution with a North American Union charter. Anyone want to bet that such a charter wouldn't declare private ownership of guns to be illegal. Without guns, we would be like the sheep in the European Union countries, unable to fight back when the Constitution falls.

The funny part is that it is all documented for anyone who cares to see. But it is as if congress, the conservative watchdogs and the general public is oblivious to what has happened (national identification card & military agreement with Canada for joint military operations in times of crisis) and what is about to happen in the future including; formation of the North American Union, introduction of the Amero currency, building the transnational twelve lane highway from Mexico to Canada through the heart of the United States. If you dislike the government now, imagine how you will feel in the future when these things start to unfold. Hopefully, there will still be enough patriots left in America to stand up and be counted for. For more information check out the following sites:

Our founding fathers were labeled as tax protesters by the English crown. We fought a bloody revolution over a 14% tax, much less than today. As for case law, that is not true. Many recent tax cases have been defeated , but you wont here about it on the news. Unfortunately the odds of getting a lame jury make most Americans reluctant to not pay fraudulent taxes. Interpretation of law is everything in court, I can assure you from my own experience. Here is a victory for Americans and hope for waking up the sheep:

The Internal Revenue Service has lost a lawyer's challenge in front of a jury to prove a constitutional foundation for the nation's income tax, and the victorious attorney now is setting his sights higher.

"I think now people are beginning to realize that this has got to be the largest fraud, backed up by intimidation and extortion and by the sheer force of taking peoples property and hard-earned money without any lawful authorization whatsoever," lawyer Tom Cryer told WND just days after a jury in Louisiana acquitted him of two criminal tax counts.

And before you consign him to the legions of "tin foil hat brigades" who argue against paying taxes, and then want payment to explain how to do that, he addresses the issue up front.

Federal Income Tax is WRONG!!

It was a temporary solution that was never intended to be a long term program..

The fact that a bunch of people will go out there and protest almost anything (IE..Fur, abortion, kids starving in some crap hole 3000 miles away) and not stand up and speak out about Taxation is beyond me...

Just my humble opinion....

My cousins ex is getting some of his tax dollars back.

He was so firm in his belief that taxes were voluntary that the Feds "invited" him to spend a few years in their "hotel". He just couldn't refuse and now gets three hots and a cot everyday.

I checked out Tom Cryer's Website. I find it all very interesting and want to research all of this further. I'm not ready to take a leap off the cliff and stop filing taxes yet though. I do like the whole idea of it and agree fully that the federal government's taxation is way out of control. Anyone thinking about taking on the IRS and the government on this issue needs to realize that it is a risk and one man's success story in fighting it does not outweigh the fact that many people have done hard time for this. Me? I'm too pretty for prison, so I'll just suck it up and keep paying for now.

Also, here is Cryer's Memorandum for his defense. It is a lot of legal mumbo-jumbo, but there is also several good points that seem to make sense.
