Thanks for the info guys. My parents have complete control of my bank account while I am gone. My Dad (ex cop) is a stickler for keeping receipts and documenting where every extra dime has went. I Also have all cancelled checks.

When I was home on leave, I mentioned this situation to a couple of cop friends and they asked who I had as an attorney. When I mentioned the attornies name, they both said, "you really hate your ex don't you?" That's a good sign. LOL.

Your attorney can be aggressive as all hell but the final decision will up to the judge/magistrate/referee who hears the case.

Mine pulled the same thing while I was in the box. Stall games work great. The court was going to side in her favor, so my attorney stalled until I could appear in person. Problem solved, no more extra money. Made evryone, even the judge look bad. Just my 411. Lawyers read Sun Tzu too I think

I also had this problem years ago. Bottom line is that your pay in Iraq will always make you max out, and there are generally clauses in all divorce agreements to allow for re-dress by both parties if income changes significantly either way.

But to protect you, all states have a max for such situations. If you are Donald Trump it would not be unbelievable that you will ALWAYS earn millions, so support can be set accordingly. However, a temporary increase, such as yours, is protected by a MAX. Usually it is right around $6000 in most states.

What that means is that they will only consider about $6000 of your monthly income, then base the state's percentage on that. So you will only pay, for example, 17% for one child based on $6000, not your actual salary.

Except for a single gig in early 2003, all three of my years in Iraq and A-stan were "off shore" so there were no 1099s or W2s. So when it became an issue in my divorce I simply told my wife (verbally....not in writing) that she could have a reasonable amount above what I already paid, or she could have nothing. She agreed to be reasonable when she realized there was no record of my pay.

Yep or you can hire attorneys do a full disclosure and drag her into court every month demanding receipts and other expenses and justification for her expenses and entitlement to your money and then start proceedings for full custody, hire a PI to show her unfit. There are many options that are available when you make a good salary just depends how far you want to take it. The only winners of this are the attorneys but fuckit to get one over on the ex is certainly worth it at times.

He said that he already pays in $500 in unofficial, unordered monies.

Friend of mine who was a PM with us got reamed hard. He left a contract voluntarily while there was still work to be done. He had completed his year committment but the child support was already ordered to be increased in conjunction with his higher pay.

The judge was very unsympathetic, stating that he chose to reduce his income and didn't lose his wages as the result of being fired or layed off. Even on a PM's state side wage, he couldn't make the child support and still afford to live.

This is a bit late but here goes. My ex had me served when I came to see my kids on leave. The trial was delayed until after I came back from mission. The court calculated additional child support based on what I made during the contract and I was declared in arrears for that amount.

Keep track of ALL expenses for your training, cell phone, travel and gear. Anything that might be work related. The court let me deduct that from my income. Keep receipts for everything you provide your children while in mission.

None of this will stop the increase but it makes a big difference in the amount you pay.

I would be more than happy to pm anyone wanting to know more about WA State.

This is just an option or another view:

I've "heard" you could deposit your money in an account outside US.

Oh and live like a king... if you have kids take care of them but do it smartly and not let the *you know what* take you to the cleaners.
