Hey Guys,
Just wondering if anyone else in the States has run into this and how it panned out.
I've got an ex that after well over a year of my being in Iraq and contibuting an unoffical average of around $500 a month extra towards child support...not to her, but in clothes for the kids or whatever, decides that due to the extra $$ I am making it's time to make the extra dollars official.
At best, I've got another 6 months or so over here and then it's back to normal pay which is way less then I have been making.
I've got a bulldog attorney on this now, but was just wondering if anyone else had been through this. I've got no problems paying extra to support the kids, but find it difficult to believe that because my income went up, the expense of the kids did as well....of course exactly proportinate to my income. Even the kids are pissed at Mom for pulling this.

Depends on what state you're from, but for the most part, I believe it's based on 21% of your net income, but if ou and your bulldog can stall long enough, then the judgement will fall under your regular stateside salary...If the court pushes for additional support, be prepared to offer up the already additional (unofficial) money that you claim to have paid.

I know that some of the UK guys in Iraq were coming up with good ways around this problem.... PM me and I will inform you how they did it.

Again, depends on the state. I know guys who are in court after every income increase and have to pay out more as they earn more. The court used a simple formula, you make more, you pay more. The only decreases/adjustments I knew of were when the ex made a big leap in salary through promotion or gained better benefits than the dad could provide.

Typically you should expect maximum allowances by state.
Stay away, don't get served, don't get a date for appearance in court until your contract is expired.
Hazardous pay increase (typically 70% of your salary) may or may not be included in the actual salary.
You're in the position to have more attorney money than her, I would imagine, so keeping her tied up in court is always an option to use as reasons for the ex to leave you alone and be happy with the fact that you already pay more than you have to.

I don't know on that, I know guys who paid more than that each month on a less than 55K cop salary. Depends on the state and how sympathectetic they are to each side. As far as keeping her tied up in court, I'd be careful. The longer it stays active, the more tracking of wages and "potential" income.

So will Va. I'm gearing up for a support hearing in a few days as a matter of fact, bringing my own jar of KY for the occassion.....Just in case.
But like Chase said, be sure you have all the documentation of all the $$'s you've given her over & above the pre-mandated $$'s set forth by the courts.
I'd even go so far as to ask for copies of clothing receipts and school supplies for the kid's too, she could inflate the cost's verbally, but a receipt will tell the tale for sure. any cancelled checks for purchases would help. Anything to show the courts that will help your case. Again, make sure everything is documented.
And again, I'm going through the exact same thing.
